Terms of Use

1. Eligibility

You represent and warrant that you are at least 18 years of age and possess the legal capacity to enter into a binding contract under the Indian Contract Act, 1872. The Platform is not directed at, and we do not knowingly collect personal data from, individuals under 18 years of age. If you provide any information on behalf of a company, trust, or other entity, you represent that you are authorized to bind that entity to these Terms.

2. Nature of the Platform

The Platform is a real estate information and lead-generation marketplace that aggregates and displays listings of projects and units sourced from independent, third-party realtors and developers (each, a "Listing Party"). Ataraxy Solutions is not, and does not hold itself out to be, a real estate agent, broker, valuer, or intermediary as defined under the Real Estate (Regulation and Development) Act, 2016 ("RERA") or any applicable state RERA rules, and is not a party to, and assumes no responsibility for, any transaction, agreement, booking, or payment between you and any Listing Party. Your use of the Platform to identify a project of interest does not create any agency, partnership, joint venture, employment, or fiduciary relationship between you and Ataraxy Solutions.

3. No investment, legal, financial, or tax advice

Nothing on the Platform constitutes investment, legal, financial, tax, or professional advice of any kind, and should not be relied upon as such. Real estate purchases involve significant financial and legal commitment. You are solely responsible for conducting independent due diligence — including verifying RERA registration, title, encumbrances, approvals, and pricing directly with the relevant authorities and the Listing Party — and for obtaining independent legal and financial advice before making any decision. We strongly recommend you do not rely solely on information displayed on the Platform.

4. Accounts and verification

Certain features (saving properties, comparisons, submitting enquiries, scheduling site visits) require an account, authenticated via one-time password (OTP) sent to your mobile number. You are solely responsible for (a) maintaining the confidentiality of your account and any credentials associated with it, (b) all activities that occur under your account, whether or not authorized by you, and (c) promptly notifying us of any unauthorized use. You agree that any information you submit — including your name, mobile number, and email — is accurate, current, and belongs to you or a person on whose behalf you are authorized to act. We reserve the right to suspend or terminate any account we reasonably believe is fraudulent, impersonating another person, or in breach of these Terms, without prior notice.

5. Listing accuracy; no warranty of third-party content

All project information, pricing, availability, images, floor plans, RERA numbers, and related details ("Listing Content") displayed on the Platform are supplied by, and remain the sole responsibility of, the relevant Listing Party. While we take commercially reasonable steps to display Listing Content as received, we do not independently verify, endorse, guarantee, or assume any liability for the accuracy, completeness, timeliness, or legality of any Listing Content, including but not limited to pricing, construction status, possession timelines, or RERA compliance. Listing Content may change without notice and may not reflect real-time availability. You acknowledge that reliance on any Listing Content is entirely at your own risk.

6. Enquiries, leads, and consent to be contacted

When you submit an enquiry, request a callback, schedule a site visit, or register interest in a service through the Platform, you expressly consent to (a) your name, mobile number, email (where provided), and enquiry details being shared with the relevant Listing Party or service partner for the sole purpose of responding to your enquiry, and (b) being contacted by that Listing Party or service partner, and by Ataraxy Solutions, via phone call, SMS, WhatsApp, or email regarding that enquiry, notwithstanding your registration (if any) on the National Customer Preference Register / Do Not Disturb (DND) list maintained under applicable Telecom Regulatory Authority of India (TRAI) regulations, to the extent permitted by law on the basis of this express consent. You may withdraw this consent prospectively at any time by contacting us as set out in Section 21; withdrawal will not affect the lawfulness of contact already made.

7. User obligations and prohibited conduct

You agree that you will not, and will not attempt to:

• submit false, misleading, or fraudulent information, including impersonating another person or entity;
• scrape, crawl, harvest, or extract data from the Platform by automated means, or reproduce, republish, or redistribute Listing Content without authorization;
• circumvent, disable, probe, or interfere with security-related features of the Platform, including rate limits and bot-verification mechanisms;
• use the Platform to transmit any virus, malware, or other harmful code, or to gain unauthorized access to any system;
• use the Platform for any unlawful purpose or in violation of any applicable Indian or foreign law, including the Information Technology Act, 2000 and rules made thereunder; or
• submit enquiries with no genuine intent to transact, including for the purpose of harassing a Listing Party or service partner.

Any breach of this Section entitles us to immediately suspend or terminate your account and access to the Platform, in addition to any other remedy available to us in law or equity.

8. Intellectual property

The Platform, including its design, layout, source code, trademarks (including "Nurexify"), logos, and all content not constituting Listing Content, is the exclusive property of Ataraxy Solutions Private Limited or its licensors and is protected under applicable copyright, trademark, and other intellectual property laws. Except for the limited right to access and use the Platform for its intended purpose, no license or right is granted to you in respect of any such intellectual property, and no part of the Platform may be copied, modified, distributed, or exploited for any commercial purpose without our prior written consent.

9. Third-party links and services

The Platform may contain links to, or integrate with, third-party websites, applications, or services (including mapping, verification, and payment-adjacent services) that are not owned or controlled by Ataraxy Solutions. We are not responsible for the content, privacy practices, or terms of any third-party service, and your use of any such service is governed solely by that third party's own terms.

10. Disclaimer of warranties

THE PLATFORM AND ALL CONTENT, FUNCTIONALITY, AND SERVICES PROVIDED THROUGH IT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED, OR THAT THE PLATFORM IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ATARAXY SOLUTIONS PRIVATE LIMITED, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATING TO (A) YOUR USE OF OR INABILITY TO USE THE PLATFORM, (B) ANY LISTING CONTENT OR YOUR RELIANCE ON IT, (C) ANY TRANSACTION, DEALING, OR DISPUTE WITH ANY LISTING PARTY OR SERVICE PARTNER, OR (D) UNAUTHORIZED ACCESS TO YOUR ACCOUNT OR DATA, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN ANY EVENT, OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED TEN THOUSAND RUPEES (₹10,000). NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

12. Indemnification

You agree to indemnify, defend, and hold harmless Ataraxy Solutions Private Limited, its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with (a) your access to or use of the Platform, (b) your breach of these Terms, (c) any information or content you submit through the Platform, or (d) your violation of any applicable law or the rights of any third party, including any Listing Party or service partner.

13. Termination

We may suspend or terminate your access to the Platform, with or without notice, for any breach of these Terms or for any reason at our sole discretion, including to comply with legal requirements or to protect the Platform, other users, or Listing Parties. You may deactivate your account at any time through the Account page. Sections that by their nature should survive termination — including Sections 8 through 12 and 16 through 20 — shall survive any termination of these Terms.

14. Force majeure

We shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including acts of God, natural disaster, war, terrorism, riot, government action, labour dispute, internet or telecommunications failure, or failure of third-party hosting, payment, or infrastructure providers.

15. Changes to these Terms

We may revise these Terms at any time by posting an updated version on the Platform with a revised "Last updated" date. Material changes will, where feasible, be notified to registered users. Your continued access to or use of the Platform after any revision takes effect constitutes your acceptance of the revised Terms. If you do not agree to a revision, your sole remedy is to stop using the Platform.

16. Governing law

These Terms and any dispute arising out of or in connection with them (including non-contractual disputes) shall be governed by and construed in accordance with the laws of India, without regard to its conflict-of-laws principles.

17. Dispute resolution and arbitration

Any dispute, controversy, or claim arising out of or relating to these Terms, including their formation, interpretation, breach, or termination, shall first be referred to good-faith negotiation between the parties for a period of thirty (30) days. If unresolved, the dispute shall be referred to and finally resolved by arbitration under the Arbitration and Conciliation Act, 1996, conducted by a sole arbitrator appointed by Ataraxy Solutions Private Limited. The seat and venue of arbitration shall be Hyderabad, Telangana, India, and the language of arbitration shall be English. Subject to the foregoing, the courts at Hyderabad, Telangana shall have exclusive jurisdiction over any matter not subject to arbitration or in aid of arbitral proceedings (including interim relief).

18. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court or arbitral tribunal of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or if it cannot be so modified, severed, and the remaining provisions of these Terms shall continue in full force and effect.

19. Waiver; entire agreement; assignment

No failure or delay by Ataraxy Solutions in exercising any right under these Terms shall operate as a waiver of that right. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Ataraxy Solutions regarding the Platform and supersede all prior agreements and understandings on the subject. You may not assign or transfer these Terms or any rights hereunder without our prior written consent; we may assign these Terms without restriction, including in connection with a merger, acquisition, or sale of assets.

20. Notices

We may provide notices to you via the email or mobile number associated with your account, or by posting on the Platform. Notices to Ataraxy Solutions Private Limited must be sent in writing to the address in Section 21.

21. Grievance officer and contact

In accordance with the Information Technology Act, 2000 and the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, the details of the Grievance Officer are provided below.
